Welcome to Sahmiye. These Terms of Service ("Terms") govern your access to and use of the Sahmiye website (sahmiye.org), mobile applications, and digital services (collectively, the "Platform").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
1. About the Platform
Sahmiye ("the Company," "we," "us," or "our") is a digital real estate marketplace registered in Somalia. We provide a platform that connects property seekers (buyers/tenants) with property providers (agents, landlords, and developers).
Important Disclaimer: Sahmiye is a venue for listing and marketing properties. We are not a real estate agency, property broker, or legal representative for any party. We do not participate in the actual transaction between buyers/tenants and sellers/landlords.
2. Eligibility
To be eligible to use the Sahmiye website and services, you must be at least eighteen (18) years of age and legally permitted to access and use the Website under the laws of the country from which you access it. In addition, you are responsible for ensuring that any person who uses the Website through your network or account is aware of and complies with these Terms and all applicable conditions.
3. User Accounts & Responsibilities
To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You must provide accurate and up-to-date information and immediately notify Sahmiye of any unauthorized access to your account. Sahmiye is not responsible for losses caused by your failure to secure your account.
4. Property Listings and Content
Property providers, including agents and landlords, must ensure that all property details, prices, descriptions, and images are accurate, complete, and not misleading, and must have the legal right or proper authorization to list the property. They are required to comply with all applicable local real estate laws and regulations in their respective jurisdictions. Sahmiye reserves the right, at its sole discretion, to remove, suspend, or modify any listing that violates its quality standards, applicable laws, or is suspected of being false, misleading, or fraudulent. Property seekers acknowledge that all property information is provided by third parties, and while Sahmiye strives to maintain high-quality listings, it does not guarantee the accuracy, completeness, or reliability of any property listing.
5. Prohibited Use
Users are prohibited from using Sahmiye services for any unlawful, fraudulent, or unauthorized purposes. This includes, but is not limited to, submitting false or misleading listings, attempting to hack, scrape, or disrupt platform operations, transmitting harmful software, spamming other users, impersonating any person or entity, or violating intellectual property rights. Sahmiye reserves the right to suspend or terminate accounts that violate these rules.
6. Intellectual Property
All intellectual property rights in the Sahmiye website, platform, software, logos, content, and materials are owned by or licensed to Sahmiye and are protected by applicable laws. You may not copy, reproduce, modify, distribute, or use any content from Sahmiye without prior written permission. Your use of the platform does not grant you any ownership rights in Sahmiye’s intellectual property.
7. Limitation of Liability
To the maximum extent permitted by law, Sahmiye is not liable for any direct, indirect, incidental, or consequential damages resulting from platform use. Sahmiye does not guarantee the accuracy of property information and users use the platform at their own risk.
8. Suspension and Termination
Sahmiye reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to the website and services at any time, with or without notice, if you violate these Terms, engage in unlawful or fraudulent activity, or misuse the platform in any way. Upon termination, your right to use the services will immediately cease. Sahmiye shall not be liable for any loss or damage resulting from such suspension or termination.
9. Modifications to Service
Sahmiye reserves the right to modify, update, suspend, or discontinue any part of its website or services at any time, with or without prior notice. Sahmiye may also change features, functionality, or content to improve the platform or comply with legal requirements.
10. Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you agree to the terms of the Privacy Policy.
11. Governing Law & Dispute Resolution
These Terms and any disputes arising from or related to the use of Sahmiye services shall be governed by and interpreted in accordance with the laws of Somalia. Any disputes shall first be resolved through amicable negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts of Somalia for final settlement.
